This document is an electronic record under the Information Technology Act, 2000 (as may be amended, modified, re-enacted, consolidated or replaced from time to time) and any/all rules made thereunder, including but not limited to those prescribed under different statutes pertaining to electronic records as applicable and amended from time to time.
For the purpose of these terms of use and service (“Terms”), wherever the context so requires, “you”, “user” or “your” shall mean any natural or juristic person who has agreed to register/sign up on the Platform (as defined below) to obtain the Services (as defined below) offered on the Platform, by providing the necessary data required to register and/or any other person who browse and/or access and/or use the Platform, in any manner whatsoever.
www.afsir.in (“Website” or “Platform” or “Afsir” or “us” or “our”), is owned, registered and operated by AFSIR CONNECT LLP (“Company”) bearing LLPIN ACH-4032 incorporated under the provisions of the Companies Act, 2013, and having its corporate office at Unit 103, Tulip Cobse, 76G, Sector - 18, Palam Road, Gurgaon, Palam Road, Haryana, India, 122015 has created this online job listings, resume management, and communication tools for job seekers and recruiters, for providing services to the Users of this Website or Platform in the name and style of “Afsir”, which is operational on the Website or Platform of the Company.
Please read these Terms carefully. If you do not agree to these Terms, please do not use the Website.
1. Definitions
- “Afsir”, “Website”, “Platform”, “we”, “us”, or “our” – refers to www.afsir.in , owned by AFSIR CONNECT LLP, including its corporate/registered office and any associated services provided through the Website or Platform.
- “Company” – refers to AFSIR CONNECT LLP, bearing LLPIN ACH-4032, incorporated under the provisions of the Companies Act, 2013, with its corporate office at Unit 103, Tulip Cobse, 76G, Sector - 18, Palam Road, Gurgaon, Palam Road, Haryana, India, 122015.
- “User”, “you”, your” – refers to any natural or juristic person who has agreed to register/sign up on the Platform to obtain the Services offered on the Platform, by providing the necessary data required to register and/or any other person who browses, accesses, or uses the Platform in any manner.
- “Services” – refers to the various functionalities and offerings provided by Afsir through the Platform, including but not limited to job listings, resume management, and communication tools for job seekers and recruiters.
- “Candidates/Personnel” – refers to job seekers who use the Platform to upload and manage their resumes, apply for job opportunities, and communicate with recruiters.
- “Recruiters/Customers” – refers to employers or their representatives who use the Platform to post job listings, search the resume database, and contact Candidates for job opportunities.
- “Account” – refers to the registered profile created by a User on the Platform, which includes personal information, resume details, and any other necessary data provided during the registration process.
- “Content” – refers to any text, graphics, images, software, and other materials available on the Website, including user-generated Content such as resumes and job listings.
- “Privacy Policy” – refers to the document outlining how Afsir collects, uses, and discloses information about Users in accordance with Digital Personal Data Protection Act 2023.
- “Cookie Policy” – refers to the document outlining how Afsir uses cookies and similar technologies to collect and store information when Users interact with the Platform.
- “Grievance Officer” – refers to the designated individual responsible for addressing User complaints and concerns regarding the Platform, whose contact details are provided in these Terms of Use.
- “Third Party Service Provider" - refers to external entities or individuals, including but not limited to concierge or brand managers, who provide services through the Platform under the necessary expertise, skill, and resources.
- “Intellectual Property” - refers to the rights pertaining to the Content on the Website, including copyrights, trademarks, and other proprietary rights owned by the Company or its licensors.
- “Force Majeure” - refers to events beyond the reasonable control of Afsir, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, etc., that prevent Afsir from fulfilling its obligations under these Terms.
- “Confidential Information” - refers to proprietary information shared between Users and Afsir, which must be kept confidential and not disclosed without prior written consent, except as required by applicable law.
- Natural Person- refers to an individual human being or user, as distinguished from a legal entity such as a corporation or partnership, who accesses or utilizes the Afsir Platform in any manner.
2. Platform and Services
- The Platform accessible via www.afsir.in (the “Website”), is owned, registered, and operated by the Company. This Platform, known as “Afsir”, provides a comprehensive job listings, resume management, and communication tools for job seekers and Recruiters, designed to facilitate job seeking and recruitment activities. For job seekers (“Candidates/Personnel”), the Platform offers services including creating and managing profiles, uploading and updating resumes, searching and applying for job listings, and communicating directly with potential Customers/Recruiters. Customers/Recruiters can post job openings, search the Candidate database, and contact potential Candidates. The Company endeavors to maintain availability of the Platform but does not guarantee uninterrupted access and reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time. Users are responsible for maintaining the confidentiality of their Account information and agree not to engage in activities that may harm the Platform or other Users. The Company may introduce new features or remove existing features at its discretion, with significant changes communicated in advance where possible.
2.2. For Candidates/Personnel:
To create an impactful portfolio, the Candidate must sign in/sign up and diligently follow the process laid down by Afsir. This can be followed by generating a portfolio which the Candidate may either build from scratch, or upload biodata/resume, or import the profile from LinkedIn.
Now, building a portfolio may require entering details such as: (i) Personal and professional details which may include Candidate’s image, name, date of birth, contact information, address, service sector, total years of experience, last held government position etc. (ii) Education details which may include graduation details, post-graduation details and doctorate/PhD details. (iii) Work Experience which may include department name, job title, skills and responsibilities etc. (iv) Achievements which may include awards/achievements name, date and description.
As the Candidate searches for the desired opportunity, they have an option to apply filters such as onsite/remote, industry and location to view for the potential employers, the Candidate may also customize, download, or share the portfolio directly with employers as the Candidate apply for its choice of opportunity.
2.3. For Customers/Recruiters:
The recruiter may first need to sign in/sign up the Platform designated for its service, initiate the process by setting up the Account through verifying contact number and email and thereafter entering the details of the recruiter and its Company along with the additional information and the Company’s logo.
After the Account setup the recruiter must have the option to perform functions such as posting about the jobs and responses according to the recruiter Company’s need through providing the details of the job description and other necessary skills/responsibilities required as per the job and then search/save desired resume which will be picked by the Afsir’s algorithm based on its own compatibility meter.
The recruiter may further apply filters such as department, years of service, education and specialization to find the desired Candidate and then have the option to pick and approach the perfect Candidate from the provided list by the Afsir.
3. Acceptance of Terms
By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
4. Use of the Site
- Eligibility
You must be at least 18 years of age to use the Website. By using the Website, you represent and warrant that You meet the age requirement. - Account Registration
To access certain features of the Website, you may need to register for an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your Account. - Prohibited Conduct
You agree not to use the Website for any unlawful or prohibited purpose. You shall not:
- Use the Website in any manner that could damage, disable, overburden, or impair Afsir server, or the networks connected to any Afsir server.
- Interfere with any other party’s use and enjoyment of the Website.
- Attempt to gain unauthorized access to any services, user Accounts, computer systems, or networks connected to any Afsir server or to the Website, through hacking, password mining, or any other means.
- Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Website.
5. Use of Platform Service
If you are one of our applicants, we will collect information youvoluntarily provide to us. We use the information collected for Human Resources purposes to administer benefits to workers and screen applicants. The collected information may include: -
- General Information: The Platform provides an online Platform for job seekers ("Candidates") and employers ("Recruiters"). It is designed to facilitate the posting and searching of job opportunities, as well as the uploading and managing of resumes.
- For Recruiters: Recruiters may post job listings, search our resume database, and contact Candidates for job opportunities. By posting a job, you agree to provide accurate and detailed information about the job opportunity and comply with all applicable laws and regulations related to employment practices. Unauthorized access to our resume database is strictly prohibited.
- For Candidates: Candidates can upload and manage their resumes, apply for job opportunities, and communicate with Recruiters. By uploading a resume, you agree to provide accurate and complete information about your qualifications and experience. You are responsible for maintaining the accuracy of your profile and resume.
- Refund/Cancellation Policy: If you are not satisfied with the services, you may request a refund within 30 days of the transaction, provided no significant usage has occurred. Cancellations of subscriptions or services must be done through your Account settings. Refunds will be processed within 14 days of approval.
6. Cancellation or Termination of Services
- You have the right to cancel or delete your Account at any time by deleting the same through the Website. This action is irreversible and once an Account is deleted by you, all the data associated with your use of the Services will be removed permanently.
- Afsir strives to improve their services every day and bring you added functionality that is engaging and useful. This implies that Afsir has the right to introduce or remove some features, and if these activities do not substantially influence your rights or responsibilities, Afsir is under no obligation to give you notice before taking such measures. Afsir also retains the right to suspend the Service completely. Herein, Afsir will inform you in advance unless extenuating conditions, such as safety or security concerns, preclude us from doing so.
- You have the right to delete your Account, for any reason that you may deem fair, by following the directions prescribed in the "Settings". Afsir reserves the right to delete your Account at any time without notice if it is certain that you have dishonored this Agreement. Upon such deletion or termination, you are not entitled to any refund for the purchases made by you.
7. Legal Compliance
By accessing this Website, you agree to abide to all the applicable Indian laws, statutes, ordinances, and regulations as regards your use of our Website. Afsir possesses the right to examine grievances or informed violations of our Terms and to take action where it considers appropriate, including but not limited to terminating your Account, reporting any alleged criminal activity to legal executives or regulators, and releasing any material essential or suitable to such individuals or entities concerning to your profile, e-mail, usage, posts, IP address, and traffic information, as permissible under Afsir’s Privacy Policy. You must consent to immediately inform the Company on the occasion that you come across any unauthorized or prohibited use of the Website.
8. Intellectual Property
- Ownership
The Content on the Website, including text, graphics, images, and software, is the property of the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. - Limited License
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, public display, publicly perform, republish, download, store, or transmit any of the material on the Website, except as follows:
- Your computer may temporarily store copies of such materials incidental to your accessing and viewing those materials.
- You may print or download one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
- If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
C Trademarks
The Afsir name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of the Company or its affiliates or licensors. You must not use such marks without the prior written permission of the Company. All other names, logos, product and service names, designs, and slogans on this Website are the trademarks of their respective owners.
9. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and disclose information about you in accordance with the Digital Personal Data Protection Act 2023. By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.
10. Communication Policy
- User Communication: By creating an Account, you consent to receive communications from us, including but not limited to notifications, updates, promotional materials, and other information related to the services provided.
- Opt-Out: You may opt-out of receiving non-essential communications by following the unsubscribe instructions provided in the communication or by updating your Account settings.
- Service Announcements: We may send you service-related announcements when necessary. You cannot opt-out of these communications as they contain important information about the services.
11. Express Consent and Acknowledgement
By registering, accessing, or using the Platform, you expressly consent to and acknowledge the terms and conditions set forth in this Agreement. You acknowledge that your continued use of the Platform signifies your ongoing acceptance of these Terms and any updates made to them.
12. Modification and Amendment
We reserve the right to modify or amend these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Platform or through other communication methods. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to events beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, and shortages of transportation facilities, fuel, energy, labor, or materials.
14. Indemnification
You agree to indemnify, defend, and hold harmless Afsir, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms and your use of the Services.
15. Limitation Of Liability
- Users shall access the Platform voluntarily and your Use of Services is entirely at your own risk. Financial and non-financial transactions performed by you on the Platform are always processed by you or under your exclusive authorization. We, to the fullest extent permitted by law, shall not, in any event, be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, monetary or any other damages (including but not limited to any accident, injury, death, loss of property), fees, fines, penalties and liabilities whatsoever arising out of (i) errors, mistakes, or inaccuracies of the Content available on the Platform, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and/or use of the Platform, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from the Platform, (v) any bugs, viruses, trojan horses, malware or the like, which may be transmitted to or through Our Platform by any third party, (vi) use of any Service offered by way of the Service and/or (vii) any errors or omissions in any Content for any loss or damage of any kind incurred as a result of Your reliance on or use of any Content emailed, transmitted, or otherwise made available via the Platform, whether based on warranty, contract, tort, or any other legal theory, and whether or not we are advised of the possibility of such damages. We shall have no liability under these Terms.
- User further acknowledges and accepts that the Services offered by us on the Platform may be provided through third party service providers, including but not limited to concierge or brand managers or their employees, agents and/or service providers, who possess the necessary expertise, skill, and resources to provide the Services to you. Hence, Afsir shall not be held liable for any conduct or negligence of the Users, in the provision of the Services, in any manner whatsoever.
- Provision of the Platform does not constitute an institution of agency between us and any of our Users. Our relationship with each and every individual User shall be on a principal-to-principal basis only. You are solely responsible for any breach of your obligations under this Agreement, applicable law and/ or the consequences of any such breach.
- We shall not be liable for any acts or omissions of the Candidates or Personnel providing their Services through the Platform. We shall not be responsible for the accuracy or authenticity of the Services provided, or privileges offered by the Candidates or Personnel through the Platform. Any guarantee, warranty and/ or insurance with respect to the Services offered by the Candidates or Personnel shall be subject to the guarantee, warranty and/ or insurance provided by the respective Candidates or Personnel. We shall not be liable for any loss and/ or damages to any Person resulting from any suits, scams, bankruptcy proceedings or court orders in respect of or against the respective Vendors.
- We will not be responsible for any Content, Services, privileges, offers available on third party media Platforms by our Users or by us and we shall not be liable for the authenticity and availability of such Content. You agree and acknowledge that the Services offered by the Candidates or Personnel through our Platform are subject to availability of such Services with the Vendor and may require a prior booking/ appointment by the User. For example, if a User has access to 50% (fifty percent) discount on stay at a specific hotel, as a privilege, then we will not be responsible if that specific hotel is sold out on a specific date and no rooms are available for the User to avail the said privilege on the said date.
- We will not be liable for any acts or omissions of any third party, or for any unauthorized interception of the Platform or Services or any breach of this Agreement attributable in full or in part to the acts or omissions of third parties, or damages associated with features that We do not furnish, or damages that result from the operation systems, equipment, facilities or Services provided by third parties to you.
- You agree to defend, indemnify and hold harmless Afsir, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) Your use of and access of the Platform; (ii) Your violation of any term of these Terms or our Policies; (iii) Your violation of any third party right, including without limitation, any copyright, property, or privacy right; or (iv) any claim that your use of the Platform has caused damage to a third party.
- In the event of your breach of these Terms and relief in the form of money or damages is not available to the Company/Platform, we shall be entitled to obtain an injunction against such a breach from any court of competent jurisdiction. Our right to obtain such relief shall not be limited to obtain other remedies.
16. Warranties
- The Services on the Platform are provided on an “as is” and “as available” basis for your use, without any representations, warranties or conditions of any kind, either expressly or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability and We assume no liability for the accuracy or completeness or use or non-obsolescence of any information on the Platform. The information, software, and Services forming parts of the Services have been contributed by various Vendors and may include inaccuracies or typographical errors. Any advice received or inferred via the Services should not be relied upon by a User for any personal, legal or financial decisions and a User should consult an appropriate professional for tailored advice, specific to their situation.
- Afsir shall not be liable to update or ensure continuity of information or Content contained on the Platform. We would not be responsible for any errors, which might appear in such information, which is compiled from third party sources, Vendors or for any unavailability of such information or Content on the Platform. We make no warranties that the (i) Service will be uninterrupted, timely, secure or error free; (ii) the quality of Services, information will meet Your expectation.
- We reserve the right and discretion to make any changes/corrections or withdraw/add Contents at any time without notice. Neither Afsir nor any third parties or Vendors, provide any warranty or guarantee as to the accuracy, punctuality, performance, completeness or suitability of the information and materials found or offered on the Platform for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
- In the preparation of the Platform and Content therein, every effort has been made to offer the most current, correct, and clearly expressed information possible. Nevertheless, inadvertent errors may occur. Any feedback from a User is most welcome to make the Platform and Contents thereof error free and user friendly.
- We make no warranties or representations whatsoever regarding the quality and competence of any Vendor and would not be responsible for any deviant behaviour of any such Vendor. Any feedback from User relating to the same is most welcome and Afsir reserves the right and discretion to take any action in this regard.
- Afsir shall not be responsible for any delay or failure of our performance of any of Services or obligations caused by events beyond reasonable control, including but not limited to events such as act of war, hostility, or sabotage; natural disaster; electrical, internet, or telecommunication outage; or government restrictions or regulations.
17. Entire Agreement
These Terms, along with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Afsir regarding the use of the Platform and supersede any prior agreements or understandings, whether written or oral.
18. Governing Law and Jurisdiction
- You acknowledge and accept that the Services provided through our Platforms may be controlled and operated from and through, any country and may be subject to the laws of that country. When You access the Services from any location, then, you are responsible for compliance with the local laws applicable to You.
- These Terms shall be governed by and shall be construed in accordance with the laws of India, without regard to the conflict of law principles. All disputes relating to this Agreement shall be settled in the courts located at Haryana, India, and you hereby accede to the jurisdiction of such courts.
- You agree that any cause of action arising out of your access to the Platform shall be commenced within 30 (thirty) days after (a) when such cause of action accrues; or (b) when You become aware of the facts giving rise to the cause of action, whichever is later, else, such cause of action shall be permanently barred.
19. Miscellaneous
- Confidentiality: You may be given and have access to confidential and proprietary information of the other users pursuant to the Services provided under this Agreement. You will not use any such Confidential Information for Your own corporate purposes or any other purpose (except as contemplated under this Agreement) without a prior written consent of the Person owning such information and shall use their best efforts to keep confidential and not to disclose to any Person any such confidential and proprietary information, except as mutually agreed or required by applicable law.
- Display Association: We shall have a right to display and publicize our association with You, other Users and the Services we have provided to our Users, in our collateral and branding materials.
- Severability: If any provision of this Agreement is determined to be unenforceable then such provision shall, to that extent, be deemed deleted from this Agreement and the legality, validity, and enforceability of the remaining provisions of this Agreement shall not be in any way affected. Any act of either us or the User, done prior to the provisions being held unenforceable shall be deemed to be valid and binding on the other.
- Waiver: Waiver by us of any one default of any one User will not waive subsequent defaults of the same or different kind, by the same or different User, and no failure or delay of Us to exercise or enforce any of its rights hereunder shall act as a waiver of those rights.
- Assignment: While the Users shall not assign or transfer any of their rights or liabilities under this Agreement to any other Person, we may freely assign our rights and benefits (in full or in part) under this Agreement to any Person. You acknowledge that We have a right (but not the obligation) to deliver the Services either ourselves, or, through Our affiliates or any third parties.
- Complaint: In the event, Users have any questions, comments, complaints and requests regarding these Terms or Our Policies, you may address the same to the designated Grievance Officer in respect of the Platform. Any complaints or concerns with regards to any Content on the Platform or any breach of the Terms or Our Policies can be directed to the designated officer in writing and the details are as follows:
- Any details or query in relation to collaborations or careers may be raised/intimated to Us, through an email addressed to our Grievance Officer at grievances@afsir.in.
- Any complaint, concern or query with respect to orders and/or services forming part thereof may be raised through an email at connect@afsir.in
- Notices: We may post notices within the Platform or send you notices on the registered e-mail address or the telephone numbers shared with Us. You will deemed to have received such notices, if sent via e-mail, within 24 (twenty-four) hours of Us sending the notice. Your use of Services after expiry of 3 (three) days from the day notice was sent, shall constitute receipt and acceptance of the notices sent to You.
- Non-compete and Non-solicit: You will not, directly or indirectly, (i) solicit or attempt to solicit, induce or recruit, engage or in any other way encourage our employees, consultants, Vendors or Users to terminate their respective engagements with us and/ or engage with You and/ or any third party; or (ii) engage in any activity which is same or similar to the Platform or the Services.

I HEREBY ADMIT THAT I HAVE READ AND AGREED TO THESE TERMS OF USE, AND THE PRIVACY POLICY AND COPYRIGHT POLICY SET FORTH BY AFSIR. I ACKNOWLEDGE THAT MY USAGE OF THE AFSIR PLATFORM IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE GOVERNED BY ALL OF THE TERMS OF THIS AGREEMENT.
